Special Meeting of the Lakewood City Council called to order at 6:00 P.M. by President Seelie.

Present: Councilmembers Patrick S. Corrigan, Ryan Patrick Demro, Michael W. Dever, Denis P. Dunn, Edward FitzGerald, Mary Louise Madigan, Robert M. Seelie.

In accordance with Article III, Section 4, of the Second Amended Charter of the City of Lakewood, you are hereby notified hat I am calling and there will be a Special Meeting of Council to be held Wednesday, December 15, 2004 at 6:00 PM in the Jury Room of Lakewood City Hall.

Communication to the Docket dated September 7, 2004 re: Sale of 1440 Arthur Avenue, Lakewood, OH.

Ordinance No. 82-04 – AN EMERGENCY ORDINANCE authorizing and directing the Director of Finance (Director) to enter into an agreement with a licensed real estate broker to market for sale the real property located at 1440 Arthur Avenue for a period of 120 days, pursuant to Section 155.07 of the Codified Ordinances. (Placed on 1st reading & referred to the Finance Committee 9/7/04, Placed on 2nd Reading 9/20/04, Adopted 10/4/04).

Discussion was had on the terms of agreement and the appraised value of Arthur House. It was indicated that all offers were less than the $200,000 appraised value.

Mayor George indicated all efforts were made to provide information to a potential buyer all circumstances, concerns, of the home.

Council President Seelie provided that the ordinance to engage a real estate agent was passed October 4, 2004.

Mayor George indicated he called the meeting to keep Council informed of the sale of the property.


Paula Reed, Real Estate Agent, indicated the house was listed on 11/18/04 and that there were twenty showings not counting open houses form the 15th to the 18th. The property was listed at $189,900, and on 11/24/04 there was an offer of $163,900, on 12/2/04, 154,000 plus in cash.

An offer of $180,250 was received and considered very good. It was also an advantage to the City that the buyer was ready to close January 14. It was indicated the City would net $164,000 after all closing costs.

The agreement would mean that the buyer assumed the costs of repairs after minor electrical violations were corrected.
The prospective buyers were presently Lakewood residents.

In order to prepare the house for sale, the house required substantial clean-up; a tilting column on the front porch, parts of the porch foundation, and minor repairs for the garage needed to be addressed. The kitchen also needed work, the east wall had paint pealing, the porch required painting, the front and rear of the house had small painting touch-ups, small holes in the bedroom needed repair as it caused some insulation to be loose.

Human Services Director Buckon indicated that the buyer signs and affidavit that he/she will pay for corrections needed.

Councilmember Dever asked if the corrections were major since electrical and foundation were mentioned. In response it was discussed that the foundation on the porch was considered a minor issue and all other concerns were considered minor.

Motion by Mr. Seelie, seconded by Mr. Corrigan to concur in proceeding with the sale of the property.
